🚦Canceling the trademark

Any trademark that has not been used for three years is subject to cancellation. It's very easy.

First and foremost, evidence of use of the trademark must be submitted by the applicant holding the trademark rights.

We only request cancellation to the Patent Office and only check the evidence.

After filing a domestic trademark application, if the examiner issues an OA explaining why the applicant has a priority trademark, the applicant can request cancellation on the grounds that the trademark has not been used for three years.

This is a very effective way to overcome OA.

However, for previous trademarks, three years must have passed from the date of registration.

If there are grounds for invalidation of an existing trademark, an invalidation trial can be filed with the Korean Intellectual Property Office.

The biggest reason is that there are the same famous brands in other countries. Alternatively, there may be a case where the applicant files the application alone in a partnership or contractual relationship.
